Following are two weeks worth of cases that have been disposed in the Union County courts. They include everything from traffic to trucking/transportation to criminal cases.

As is sometimes the case, persons listed in this service feature of the Siouxland Observer may have multiple offenses. These offenses are listed separately under each individual. You will also notice upon reading that many of the offenses are dismissed by the state’s or prosecuting attorney. This may be due to the person being charged pleading guilty to a lesser offense or the state’s attorney deciding there wasn’t enough evidence to charge the person. Still, the original offense stays in the court record unless it is erased by the judge for some reason.

As we mentioned in the introduction to the last report, sometimes charges are updated as new information is obtained about a case. These can be identified by the phrases “Disposition: Recharged by Complaint/Petition”, “Disposition: Recharged-by Information” or something similar. These show that an earlier charge was dismissed by the county attorney and the defendant has likely been recharged on a more recent date. There is also a date preceding these disposition statements indicating when they were made giving the reader an idea of the chronological order of the defendant’s case.

It’s interesting to consider the number of charges the county has placed against an individual. At first glance, it would seem some people have charges numbering in the double digits. A case in point this week would be Justin Kellie Harsock of Elk Point. It looks like he had 18 charges against him for various offenses: 10 misdemeanors and eight felonies. But you would be mistaken if you looked at Harsock’s case that way. In fact, it turns out with what appears to be 18 charges that he racked up are really nine original charges.

Looking more closely at the charges and the dates of disposition you’ll see that the three Contributing to the abuse, neglect or delinquency of a minor (misdemeanor 1) charges first appeared on Jan. 18 when he was re-charged by information. This means the prosecuting attorney received more information about the case and wanted to continue it at a later date – March 11. The same was true for the charges of Keeping a place for the use or sale of a controlled substance (felony 5), Unauthorized ingestion of a controlled substance in schedules I or II (felony 5), two charges of possession of a controlled substance in schedules I or II (felony 5) and Possession of two ounces of marijuana or less (misdemeanor 1).

In the end, on March 11, all but two charges were dropped against Hartsock: Keeping a place for the use or sale of a a controlled substance – a felony for which he received a suspended imposition of sentence – and Contributing to the abuse, neglect or delinquency of a minor – misdemeanor – for which he also received a suspended imposition of his sentence. Of course, Hartsock received fines, court costs, surcharges, and jail time. Furthermore, he also was placed on probation and he cannot have contact with minor children in the home who are not related to him.

Of course, the two charges were bad enough. As they say, it could have been worse. Below are the details of Harsock’s charges and the resulting consequences, as well as others with cases disposed in the Union County Court.

One more item to note: Take a look at a couple of the hefty fines for “Overweight on axle” penalties assessed to truckers. The eye-popping one is toward the end of the list. There are four truck drivers that had penalties over $1,000, including one pushing the 10 grand mark. That’s a lot of dough for an over-the-road trucker to come up with in Union County, S.D. You’d think they’d figure out they needed to not overload their trailers that much. Sheesh!
