Iowa man alleges confused deputies mistakenly searched his home

Dustin Konrady, a resident of Cherokee, Iowa, is suing two deputies for mistakenly entering and searching his home while attempting to search a neighbor’s house. The deputies are being sued for trespassing, assault, and conducting a warrantless search. The lawsuit alleges that the deputies unlawfully entered the houses and covered their body cameras and microphones during the search. WITCC settles the second of two human trafficking lawsuits

Counties hit with $74,000 in plaintiffs’ attorney fees for trying to restrict petition circulators

The Minnehaha County Courthouse and Lawrence County violated the First Amendment rights of petition circulators. They had to pay $74,000 in attorney fees and costs. Dakotans for Health threatens lawsuit over signature withdrawal bill

The group sponsoring a constitutional amendment to expand South Dakota abortion rights said it will likely file a lawsuit if legislators pass a bill allowing petitioners to withdraw signatures that already have been certified for the ballot.

“I can’t speculate about whether the bill will pass or not,” said Rapid City lawyer Jim Leach, who represents Dakotans for Health, a grassroots organization that pushes for progressive policy through petition efforts. “I can say that if it does pass, there’s certainly a substantial possibility of legal action.”

At issue is House Bill 1244, which would change South Dakota’s ballot initiative process by allowing an individual who signed a petition to withdraw their signature by sending a written notification to the Secretary of State’s office. This could occur after the petition effort has been validated but is still eligible to be challenged through the Secretary of State or court appeal. Federal judge hears arguments in lawsuit challenging Iowa book law

A U.S. District Court judge heard oral arguments Friday about whether to stop enforcement of measures in an Iowa education law that ban certain books with sexual content from K-12 school libraries.

The lawsuit challenges sections of Senate File 496 that require schools to remove books with depictions of sex acts. It also challenges a provision requiring schools to inform parents if a student requests the use of a different name or pronouns than what they were assigned at birth. The lawsuit claims those and other measures violate Iowa students’ constitutional rights to equal protection, free speech, free association and due process, the lawsuit claims. WITCC wants to depose alleged human trafficking victims in Iowa

Western Iowa Tech Community College, a community college in Sioux City, Iowa that’s facing two multimillion-dollar lawsuits alleging it engaged in human trafficking is arguing the alleged victims must return to Iowa from Chile to sit for depositions in the case.
